BeAnywhere Real Estate Agent Terms & Conditions
Effective Date: July 11, 2026
These Real Estate Agent Terms & Conditions ("Agreement") govern the use of the BeAnywhere platform by all registered real estate agents, agencies, brokers, and property professionals ("Agent", "you", or "your"). By registering, accessing, or using the BeAnywhere platform, you agree to be bound by these Terms & Conditions.
1. About BeAnywhere
BeAnywhere ("BeAnywhere", "we", "our", or "us") operates an AI-powered property and lifestyle platform that connects property owners, real estate professionals, buyers, renters, expatriates, digital nomads, and consumers through its website, mobile applications, and related services.
2. Eligibility
To register as an Agent, you confirm that:
- You are legally authorised to market, rent, or sell properties.
- All information provided during registration is true and accurate.
- You will maintain accurate and up-to-date profile information.
- You have the authority to represent the properties you advertise.
3. Property Listings
Agents may upload property listings to the BeAnywhere platform.
You agree that:
- All listings are accurate and truthful.
- You have permission from the property owner or authorised representative to advertise the property.
- Property photographs, videos and descriptions do not infringe any third-party intellectual property rights.
- You will promptly update listings when a property is rented, sold, or otherwise becomes unavailable.
- Duplicate or misleading listings may be removed without notice.
BeAnywhere reserves the right to edit, reject, suspend, or remove any listing that does not meet platform standards.
4. Commission and Transaction Fees
Rental Transactions
For every successful rental transaction introduced through BeAnywhere, the Agent agrees to pay BeAnywhere a commission equal to:
15% of the total commission earned by the Agent from the rental transaction.
The commission becomes payable immediately upon completion of the rental agreement or when the Agent receives payment from the client, whichever occurs first.
Property Sales Transactions
For every successful property sale resulting from a lead or introduction generated through BeAnywhere, the Agent agrees to pay BeAnywhere:
0.25% of the final property sale price.
This fee becomes payable immediately upon completion of the sale or transfer of ownership.
5. Reporting Transactions
Agents must notify BeAnywhere of every completed rental or sales transaction generated through the platform within five (5) business days.
The notification must include:
- Property reference
- Client name
- Transaction value
- Date completed
- Commission earned (for rentals)
BeAnywhere reserves the right to request supporting documentation to verify completed transactions.
6. Payment Terms
Unless otherwise agreed in writing:
- All fees are payable within seven (7) calendar days of completion of the transaction.
- Late payments may incur interest at 1.5% per month or the maximum rate permitted by applicable law.
- BeAnywhere reserves the right to suspend Agent accounts with outstanding balances.
7. Non-Circumvention
Agents agree not to deliberately circumvent BeAnywhere by avoiding payment of applicable commissions on transactions originating from:
- BeAnywhere enquiries
- Website leads
- Mobile application leads
- AI recommendations
- Referral introductions
- Viewing requests
- Customer enquiries received through the platform
Any attempt to avoid payment constitutes a material breach of this Agreement.
8. Lead Ownership
Customer enquiries submitted through BeAnywhere remain recorded within the platform.
BeAnywhere reserves the right to verify whether a completed transaction originated from a BeAnywhere lead.
9. Marketing
By listing properties, Agents grant BeAnywhere a worldwide, royalty-free licence to:
- Display listings
- Promote listings
- Optimise listings for search engines
- Use photographs and descriptions in marketing campaigns
- Feature listings across social media and AI-powered recommendations
Ownership of listing content remains with the Agent or property owner.
10. Agent Responsibilities
Agents agree to:
- Act professionally at all times.
- Respond promptly to enquiries.
- Treat customers fairly.
- Comply with all applicable laws and regulations.
- Maintain confidentiality of customer information.
- Provide accurate pricing and availability.
11. Prohibited Conduct
Agents must not:
- Upload false listings.
- Misrepresent properties.
- Discriminate against customers.
- Engage in fraudulent conduct.
- Upload copyrighted material without permission.
- Attempt to manipulate platform rankings.
- Circumvent platform commissions.
12. Account Suspension
BeAnywhere may suspend or terminate an Agent account immediately if:
- Fees remain unpaid.
- Fraudulent activity is suspected.
- These Terms are breached.
- Repeated customer complaints are received.
- False property information is provided.
13. Intellectual Property
All BeAnywhere branding, software, AI technology, website design, databases, and intellectual property remain the exclusive property of BeAnywhere.
Agents may not reproduce or copy any part of the platform without written permission.
14. Limitation of Liability
BeAnywhere acts solely as a technology platform facilitating introductions between customers and Agents.
BeAnywhere:
- Does not guarantee transactions.
- Does not guarantee customer quality.
- Is not responsible for negotiations between parties.
- Is not liable for losses arising from transactions between Agents and customers.
15. Indemnity
Agents agree to indemnify and hold BeAnywhere harmless from any claims, losses, damages, legal costs, or liabilities arising from:
- Property listings
- Misrepresentation
- Breach of these Terms
- Regulatory breaches
- Customer disputes
16. Privacy
Agents agree to comply with all applicable data protection and privacy laws when handling customer information obtained through BeAnywhere.
17. Amendments
BeAnywhere may update these Terms & Conditions from time to time. Continued use of the platform after any updates constitutes acceptance of the revised Terms.
18. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Kingdom of Thailand, unless otherwise required by mandatory local law.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Thailand.
19. Acceptance
By creating an Agent account, uploading property listings, or using the BeAnywhere platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions.
