Terms of Use

1. Agreement

These Terms of Use (“Terms”) govern access to and use of the website, applications, and related services operated under the name BeAnywhere (“Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Where the Service involves agreements made by electronic means, the use of the Service may constitute communications and records under the Electronic Transactions Act B.E. 2544 (2001) and its amendments, as applicable.

2. Contracting party

The legal entity operating the Service (“we”, “us”) is identified on the Service or through our contact channels. All notices relating to these Terms may be sent using the contact details we publish on the Service.

3. Nature of the Service

The Service is a technology platform that may display property listings, neighborhood information, and related content. We may facilitate introduction to landlords, agents, or other third parties, but unless we expressly state otherwise in a separate signed agreement, we are not a party to any lease, sale, or brokerage contract between you and any third party.

Listings and descriptions are supplied by users or third parties. We do not warrant that information is complete, current, or accurate. You must verify all material facts (including title, encumbrances, possession, and permissions) independently and obtain your own legal and financial advice before entering into any transaction.

4. Eligibility

You must have capacity to enter binding obligations under applicable law, including where relevant the Civil and Commercial Code of Thailand, to use those parts of the Service that require registration or submission of personal data. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation.

5. Accounts and security

You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorised use.

6. Acceptable use and enforcement

You agree not to:

• Violate Thai law or the rights of others;
• Upload malware, scrape or overload the Service, or circumvent security;
• Post false, misleading, or fraudulent listings or impersonate others;
• Use the Service to discriminate unlawfully or harass users; or
• Collect personal data from other users except as permitted by the Personal Data Protection Act B.E. 2562 (“PDPA”) and our privacy notice.

We may suspend or terminate access for breach of these Terms or to comply with law or court orders.

7. Intellectual property

The Service, branding, and original content are protected by intellectual property laws in Thailand and elsewhere. Except for licences we expressly grant, you may not copy, modify, distribute, or create derivative works from our materials without prior written consent.

You grant us a non-exclusive licence to host, display, and distribute content you submit to the Service for the purpose of operating and promoting the Service, subject to our privacy notice.

8. Fees

Certain features may be subject to fees as displayed on the Service. Taxes (including VAT, if applicable under Thai law) may apply. If you are a consumer within the meaning of the Consumer Protection Act B.E. 2522 and its amendments, mandatory rules benefiting consumers under Thai law remain unaffected to the extent they apply and cannot be waived by these Terms.

9. Personal data

Our processing of personal data is described in our privacy notice and carried out in accordance with the PDPA where applicable, including requirements for lawful bases, data subject rights, cross-border transfers (where relevant), and security measures.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by Thai law. We disclaim implied warranties where permissible. We do not guarantee uninterrupted or error-free operation or fitness for a particular purpose beyond what cannot be excluded under the Civil and Commercial Code, consumer protection legislation, or other mandatory Thai law.

11. Limitation of liability

To the maximum extent permitted by Thai law, we are not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profits, data, or goodwill. Our aggregate liability arising out of these Terms or the Service in any twelve-month period is limited to the greater of (a) the fees you paid us for the Service in that period or (b) THB 5,000, except where liability cannot be limited under applicable mandatory law (including gross negligence or wilful misconduct where the law does not permit exclusion).

12. Indemnity

You will indemnify and hold us harmless against claims, damages, losses, and reasonable legal fees arising from your misuse of the Service, your listings or content, your breach of these Terms, or your violation of third-party rights or Thai law, except to the extent caused by our wilful misconduct as finally determined by a competent court.

13. Termination

You may stop using the Service at any time. We may suspend or terminate the Service or your access with or without notice where permitted by law. Provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, governing law) survive termination.

14. General

If any provision is held invalid, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.

15. Governing law and dispute resolution

These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-law rules that would require applying another jurisdiction’s laws, except where mandatory rules of Thailand direct otherwise.

Subject to non-waivable rights under Thai law (including consumer protections where applicable), the courts of Thailand shall have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service, and you submit to the jurisdiction of the courts of Bangkok, Thailand, unless a different venue is required by mandatory law.
